About these Terms

Not legal advice from a lawyer. These pages are plain-language terms written for this service. They have not been reviewed by an attorney, and reading them does not create an attorney-client relationship. Talk to your own lawyer about how the law applies to your business.

These Terms govern ZIP Seller Lists, a mailing-list service operated by Miami Expeditions LLC, a Florida company at Miami Expeditions LLC, 7924 SW 187th St, Cutler Bay, FL 33157 (we, us). The service is offered under the Properties of Miami name. By creating an account, claiming a ZIP, or downloading a list you agree to these Terms, the Privacy Policy, and the Acceptable Use Policy. The service is meant for business use by real estate professionals. You must be at least 18.

These are the terms of this lead service only. They do not modify, replace, or merge with PinOnIt's terms or privacy policy. The PinOnIt perk is a separate product provided under PinOnIt's own terms and privacy policy at pinonit.com, which subscribers accept separately when they sign up for PinOnIt. This service makes no warranties about PinOnIt.

What you get

A monthly subscription to a ranked list of property owners in one Florida ZIP code, built from public property-appraiser and Florida Department of Revenue tax-roll (NAL) records. Each file has owner name, mailing address, property address, value, years owned (exact when a sale year is on the roll, otherwise estimated), and absentee and trust/estate flags. There are no phone numbers or email addresses in the files at launch. Your first file is generated when your subscription starts, and a new file is generated each month after that.

Lists are ranked by public-record signals. We do not claim, and you may not claim, that any owner intends to sell, is about to list, or wants to be contacted. We do not guarantee leads, listings, appointments, sales, response rates, or income. The records come from government tax rolls that we do not verify. Owners may have sold, died, moved, or changed their mailing address since the roll was published, and some records are wrong or incomplete.

Launch coverage is Florida. Other states may be added later.

Plans, price, and what exclusive means

Exclusive ZIP is $29.99 per month. Shared ZIP is $9.99 per month. Prices are in US dollars. If sales tax applies it will be shown before you pay. We will give you at least 30 days' notice by email before a price increase takes effect for your subscription, and you can cancel before it does.

Exclusive means that, while your subscription is active, we will not sell this ZIP's list to any other subscriber on either tier. It does not mean that the underlying records are private. The same tax-roll information is public, and other people can get it from the county or the state or from other vendors. Several agents may hold the shared tier for the same ZIP, and a ZIP with an active shared subscriber cannot be claimed as exclusive.

An exclusive claim locks when payment succeeds. A checkout hold can reserve a ZIP for a short time (30 minutes) so two agents are not charged for the same exclusive claim. If a payment fails, your ZIP is held for 3 days. After that the subscription ends and the ZIP is released. If we cannot give you the ZIP you paid for, for example because of a conflicting claim, we will cancel the order and refund you in full.

Automatic renewal and how to cancel

Your subscription renews automatically every month. We charge the card you gave at checkout, through Stripe, at the start of each monthly period at the price you agreed to, and we keep charging it until you cancel. There is no minimum term and no cancellation fee.

You can cancel online at any time. Sign in, open Dashboard, then Account, and use the Cancel at period end button next to your subscription. That is the same place and the same way you signed up: online, with no phone call needed. You can also email stebbins.peter@gmail.com and we will cancel it for you. Cancellation takes effect at the end of the monthly period you already paid for. You keep your list and your ZIP until then, and you are not charged again. After that the ZIP is released and the subscription ends.

We show the price and the automatic-renewal terms again before you pay. By starting a subscription you authorize us to charge your card each month until you cancel.

Refunds

30-day money-back guarantee, first payment only. If your first list (or, for the owner-email add-on, your first set of emails) isn't useful, you can ask for a refund of your first payment. You must ask within 30 days of the date of that first charge, by emailing info@zipowners.com from the address on your account with your ZIP and the date of the charge. We will answer within 5 business days. A refund request cancels the subscription it covers.

Downloads. The guarantee applies only if you downloaded less than half of the records in the list (or, for the add-on, the email set) that your first payment bought. Every download is logged with its row count, and we use those logs to decide. Looking at the list on screen does not count as a download. If you have downloaded half or more, you have received the product and the guarantee does not apply, but billing mistakes are still refunded.

The guarantee covers the first payment for each product only: the first payment for a ZIP subscription and, separately, the first payment for the owner-email add-on on that ZIP. It does not cover renewals. We do not refund any payment after 30 days, we do not refund a month that has already started after your first payment, and we do not prorate partial months. Canceling stops future charges only.

Exceptions. We may decline or limit a refund, to the extent the law allows, if: (a) you have asked for refunds before on this or another account, or the request looks like abuse of the guarantee; (b) you downloaded half or more of the list, or used it in bulk, or resold, shared, or published it, or uploaded it to a service that does; (c) you started a chargeback or card dispute instead of contacting us first; (d) your account broke the Acceptable Use Policy or these Terms; or (e) the request comes after the 30 days. We may decline a refund request at our discretion where the law allows us to. Nothing in this section limits rights you have under law that cannot be waived.

We will always refund a billing mistake: a duplicate charge, a charge after you canceled, a charge for a ZIP we could not give you, or a month in which we did not deliver. Email info@zipowners.com within 30 days of that charge. Please contact us before filing a card dispute so we can fix it quickly.

The data is public-record and third-party data provided as-is. If a list or an email set is not useful to you, the refund above is the remedy we offer. We do not promise the accuracy of any record, any business result, or that an email address is current or deliverable.

Your license to the lists

While your subscription is active, you may use that ZIP's lists for your own lawful marketing, mainly postal mailers. You may not resell, sublicense, publish, or share the lists, and you may not upload them to a service that resells or shares them. Owners already sent to you are left off later months. When your subscription ends, stop using the lists for new mailings and delete them, except for your records of mail you already sent.

You are responsible for how you use the lists. You must follow the Acceptable Use Policy and all laws that apply to your marketing, including Florida real estate advertising and licensing rules (Chapter 475, Florida Statutes, and Florida Real Estate Commission rules, including brokerage identification in advertising), U.S. Postal Service rules, the Fair Housing Act, CAN-SPAM, and do-not-mail and removal requests.

Not a consumer report (FCRA)

ZIP Seller Lists is not a consumer reporting agency and the lists are not consumer reports under the Fair Credit Reporting Act. We do not assemble information to evaluate a person's creditworthiness, character, or reputation. You may not use the lists, or anything in them, to decide whether to give someone credit, insurance, employment, or housing (including tenant screening), for any other purpose that the FCRA regulates, or to make any decision about a person's eligibility for anything. You agree not to use the service in any way that would make us a consumer reporting agency.

Public records, removals, and confidential records

The lists are made from Florida public records under Chapter 119, Florida Statutes. Records of people whose information is exempt or confidential under Florida law, including section 119.071 (for example certain law enforcement personnel, judges, and others protected by statute, and their families), are excluded when they are marked that way on the roll. Owners may also ask to be removed at any time on the homeowner removal page, and we then leave them out of every list, including lists already delivered to your dashboard and exports you download later. We cannot take back mail you have already printed or sent. You must honor any removal request or do-not-mail request you receive yourself.

Calls, texts, and email

The lists are for postal mail. They contain no phone numbers. You may not use the lists to place calls or send text messages unless you have the consent and registration that the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act (section 501.059, Florida Statutes) require, and you have checked the National and Florida Do Not Call lists. Consent has to come from the person, not from the fact that their name is on a list from us. If you email anyone you must follow CAN-SPAM. We make no promise that any number or email you find or add yourself is lawful to contact.

Owner-email add-on (opening soon)

ZIP Seller Lists launches as a mailing-list service. Subscribers receive owner names and postal addresses from public records. Phone numbers are not included.

Owner-email add-on: $129.99 per month, per exclusive ZIP, added on top of an active exclusive ZIP subscription. It is not on sale until we open it on this site (the dashboard shows when it is open); until then no email purchase is possible. When you buy it, we look for an email address for the owners on your ZIP's list and deliver what we find to your dashboard and CSV export, within 2 business days of your purchase. Emails are found for some owners, not all. In our own test of 100 sampled individual owners, 75 had an email found, and results will vary by ZIP. We do not promise a minimum number of emails, and we do not promise that an address is current, deliverable, or that its owner wants to hear from you. The 30-day money-back guarantee on your first payment applies to the add-on; see Refunds.

Emails, when we have them, are stored in a central database controlled by Miami Expeditions LLC. The admin always has access to that database. A subscriber receives a license to use an email only while their exclusive subscription and add-on for that ZIP are active. When either ends, access is revoked. The subscriber may not export or retain those emails after cancellation, except for messages they already sent, and may not resell, share, or publish them. Emails stay with us and are not given to the next subscriber for that ZIP unless our data provider's terms allow it.

CAN-SPAM duties apply to anyone who emails a person: a truthful header and subject, a physical postal address, a working unsubscribe, and honoring opt-outs. Owner removal requests are honored across mailing lists and across email records. Miami Expeditions LLC does not warrant that an address is deliverable or that any person intends to sell.

PinOnIt perk

The PinOnIt perk is a separate product provided under PinOnIt's own terms and privacy policy at pinonit.com, which subscribers accept separately when they sign up for PinOnIt. This service makes no warranties about PinOnIt.

PinOnIt is described as a tool where clients book appointments and sign documents right from a text, a Calendly and DocuSign alternative for quick single-signature documents only. It is not for full multi-signature purchase contracts. Signing up for ZIP Seller Lists does not create a PinOnIt account and does not mean you have accepted PinOnIt's terms. If we offer you a PinOnIt link or code as a subscriber perk, you accept PinOnIt's terms on pinonit.com if you choose to sign up there. The perk is available to active subscribers only, may change, be limited, or end at any time, and is not a promise of any particular PinOnIt feature, price, or length of access. PinOnIt perk can't be combined with other PinOnIt trials or offers. PinOnIt may require a card and may bill its own price after any free period unless you cancel with PinOnIt.

Your account and our right to suspend

You are responsible for the accuracy of your account, brokerage, and license information and for keeping your password private. We may suspend or end an account that breaks these Terms or the Acceptable Use Policy, or that puts other people at risk. If we end your account for that reason we do not owe a refund for the current month. If we end it for any other reason, we will refund the unused part of the month you paid for.

Disclaimers and limits on our liability

THE SERVICE, THE LISTS, AND ANY EMAILS WE PROVIDE ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE DATA COMES FROM PUBLIC RECORDS AND THIRD-PARTY SOURCES. TO THE FULLEST EXTENT FLORIDA LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, CURRENTNESS, EMAIL DELIVERABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE ANY RESULTS, LEADS, LISTINGS, SALES, OR INCOME.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost commissions, or lost business, even if we were told they were possible. Our total liability for any claim about the service is limited to the fees you paid us in the 30 days before the claim arose. These limits do not apply where the law does not allow them, and nothing here limits liability for fraud or willful misconduct.

You agree to defend, indemnify, and hold us harmless from losses we suffer from claims by third parties that arise out of your marketing, your use of the lists or emails, or your violation of these Terms or the law. You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act, the National and Florida Do Not Call lists, CAN-SPAM, the Fair Housing Act, and every other law that applies to how you contact people.

Governing law and disputes

Florida law governs these Terms, without regard to conflict-of-law rules. If you have a dispute, email info@zipowners.com first and give us 30 days to try to resolve it.

If we cannot resolve it, you and we agree to resolve the dispute only by binding arbitration on an individual basis, not in court and not as a class, collective, or representative action. The arbitration will be held in Miami-Dade County, Florida, under the rules of the American Arbitration Association that apply to commercial disputes, and a court may enter judgment on the award. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO JOIN OR BRING A CLASS ACTION. Either of us may instead bring an individual claim in small-claims court, and either of us may go to court to stop misuse of intellectual property or of the lists. If the class-action waiver is found unenforceable for a claim, that claim goes to court, not arbitration.

For any dispute that is allowed in court, the state and federal courts located in Miami-Dade County, Florida are the exclusive venue, and you and we consent to those courts. If part of these Terms is found unenforceable, the rest stays in effect. These Terms, the Privacy Policy, and the Acceptable Use Policy are the whole agreement for this service. We may update them. When we make a material change we will email you at least 30 days ahead, and continuing to use the service afterward means you accept it.
